You may terminate an employee who fails to present acceptable documentation (or an acceptable receipt for a document) within three business days after the date employment begins. If you fail to properly complete Form I-9, you risk violating section 274A of the INA and may be subject to civil money penalties.

Also beginning today, employers may remotely examine employees' Form I‑9 documents provided they are enrolled in E-Verify. The alternative procedure is detailed in a notice in the Federal Register published on July 25, 2023.
The employer must physically examine the documentation establishing identity and employment authorization that the employee presents. Originals (not copies) must be examined. The one exception is the birth certificate, which can be a certified copy.

What are the new rules for I-9 in 2023?
Starting November 1, 2023, all employers must use the revised Form I-9, Employment Eligibility Verification, with the edition date 08/01/23, when completing the employment eligibility verification process. This updated Form I-9 reflects the option for eligible employers to verify employment eligibility remotely.
An unexpired Form I-327, Reentry Permit, Form N-560, Certificate of U.S. Citizenship or Form N-561, Replacement Certificate of Citizenship (PDF, 40.3 KB), or. Form N-550, Certificate of Naturalization or Form N-570, Replacement Certificate of Naturalization (PDF, 176.3 KB).
Employers and employees may choose to complete any or all sections of the form on paper or using a computer, or a combination of both. Forms I-9 obtained from the USCIS website are not considered electronic Forms I-9 under DHS regulations and, therefore, cannot be electronically signed.
Working With Authorized Representatives
Only licensed attorneys, individuals authorized under federal law to provide immigration services, and individuals qualified and bonded as immigration consultants may act as the representatives authorized for remote I-9 verification.
Use Form I-9 to verify the identity and employment authorization of individuals hired for employment in the United States. All U.S. employers must properly complete Form I-9 for every individual they hire for employment in the United States. This includes citizens and noncitizens.
As an employer, you or your authorized representative must complete and sign Section 2 of Form I-9, Employment Eligibility Verification, within 3 business days of the date of hire of your employee (the hire date means the first day of work for pay).
If you choose to complete or retain Form I-9 electronically, you may use one or more electronic generation or storage systems, as long as any Form I-9 retained in the system remains fully accessible and meets the regulations.
Employers can use a live video interaction to verify an employee's identity and work eligibility remotely during the I-9 process. You'll compare the information provided by the employee on Section 1 with their documentation for accuracy.
Starting Nov. 1, you can only use Form I-9, Employment Eligibility Verification, with the 08/01/2023 edition date. USCIS increased the maximum validity period to 5 years for Employment Authorization Documents (EADs) issued to noncitizens with certain Category codes on their EADs.
Form I-9 Storage and Retention
After employment ends, the employer must retain the employees' completed Form I-9 (and copies of documentation if applicable) for either three years after the date of hire or one year after the date employment ended, whichever is later. Guidance can be found on the USCIS website.
How long does an employer have to verify I-9?
The E-Verify verification
The verification can be completed before the employee begins work for pay; The latest — three days after the new hire's first day of work for pay, unless the employee will work for fewer than three days; for them, you must verify no later than the first day of work for pay.
You may designate an authorized representative to fill out Forms I-9 on behalf of your company, including personnel officers, foremen, agents or notary public.
Can I get in trouble if I lie on the form? Yes. You may be subject to criminal charges if you lie or present false documents for Form I-9.
You may be fined and/or imprisoned for up to five years if you: Make a false statement or attestation to satisfy the employment eligibility verification requirements; Use fraudulent identification or employment authorization documents; or. Use documents that were lawfully issued to another person.
Non-Compliance Leads to Penalties
The I-9 violations may result in civil and criminal penalties. Civil fines for I-9 paperwork violations range from $272 to $2,701 per violation and the fine increases with each repeated violation.
